The criminal process is a very intrinsic system. The procedures followed are different for state and federal cases. It is made up of checks and balances that ensure everyone gets due process while dealing with the system. This document will discuss the federal procedure, the protections provided by the Constitution, the chronological process from arrest to appeal, as well as future changes to improve the process. Wright states that "the roots of criminal procedure are found in the Bill of Rights, which addresses such fundamental principles as protection against unreasonable searches and seizures, double jeopardy, self-incrimination, excessive bail, the right to a trial by jury, a effective lawyer and the confrontation of witnesses” (2013). rules of criminal procedure must be followed by everyone, including the police, defense lawyers, suspects, judges, witnesses and victims investigations, the arrest and the trial. It would be unethical not to recognize a person's rights. Not following the criminal procedure is not only a violation of the law but is morally wrong and unjust arrest is considered a seizure of a person. The Fourth Amendment is the amendment that protects people from unreasonable searches and seizures, but our text states “However, it does not protect people from any invasion of their privacy.” (Wright, 2013, 9.1). Therefore there are many circumstances in which the police can legally conduct a search without a search warrant. Custody can be obtained voluntarily or by force and is the response to criminal charges based on probable cause. The conditions are set at the discretion of the judge. Nonviolent offenders are usually first considered for parole. The length and terms of probation are established at the time of sentencing. Changes in criminal justice are beneficial and harmful at the same time. The changes are beneficial, because technological advances will help catch and identify criminals and will also act as a deterrent against crime. It is harmful because, just as new technologies and advances are made available to law enforcement, they are also sought by criminals. I think Scmallenger said it best: “Although the crimes it faces may change, the American criminal justice system of the future will likely remain recognizable through its cornerstone systems: the police, the courts, and correctional facilities.””.” (2011).
