Topic > The Wives of the Quran and Forced Marriage - 1939

The practice of marriage is an institution that has existed for centuries. Mostly marriage is considered one of the best forms of relationship as kinship between two individuals. Marriage usually occurs when both parties make their relationship public, official and permanent. The Legal Information Institute at Cornell University Law School defines marriage as a legal union of a couple under the following conditions: 1) both parties must be legally capable of marrying 2) mutual consent 3) a legitimate marriage contract (Gangoli et al , 2011: 26) (Marriage). This definition of marriage is ideal for practice, but in reality sometimes this is not the case. Sometimes, the issue of consent is debatable because consent can be given as a result of manipulation and coercion; therefore, individuals can marry forcibly. Women are usually victims of forced marriages, but not all marriages are forced and both men and women have the same potential to be victims of forced marriages. Forced marriage is defined as “a marriage that takes place without the free or valid consent of one or both partners and involves physical or emotional coercion (Gangoli et al., 2011: 26). Child marriage is linked to forced marriage because minors are deemed incapable of giving informed consent” (Thomas, 2009: 2) . This definition of forced marriage includes the words “free and valid consent” because consent can be obtained but does not always mean that it is obtained without threats, coercion or force. One of the most barbaric forms of marriage practice in some countries is marrying a girl with an object, for example marrying a girl with the Quran, a holy book.
