The state adopted one of the pioneering bans on the possession of semi-automatic rifles, enacted in 1989. More restrictive measures were later added. Unlike many other states, California has no provisions granting private individuals the right to own, purchase, or bear firearms. This has led to many challenges to the provisions in federal courts, especially since the Supreme Court ruled that the Second Amendment provision is enforceable in all states (McDonald, 2010). The state bans weapons with specific names, including the UZI and AK 47, as well as bans weapons based on their characteristics that make them assault weapons. Such features include: flash suppressor, rocket launcher, grenade launcher, thumbhole stock, forward pistol grip, conspicuously protruding pistol grip located below the action of the weapon, telescoping or folding stock, threaded barrel, seconds grip , ability to accept ten or more rounds, among other specifications (California Firearms Laws, 2007). All automatic firearms, rifles and short-barreled pistols are prohibited. Regarding concealed weapons, California is considered a “possible problem,” ranging from no problem, especially in urban regions, to release in rural areas (California Firearms Laws, 2007). The state does not recognize permits to carry concealed weapons from other states. To purchase a gun you must obtain a gun safety certificate which is issued after passing the written test. All guns transferred into California must be certified by the state, while private sales must occur through a licensed gun dealer. Prohibited areas include hospitals, law enforcement buildings, schools, places where alcohol is sold and consumed, airports, state parks, and federally prohibited locations. As far as public opinion is concerned, the open carry ban is currently being challenged in the courts. Public opinion has also recently been influenced by the recent case involving the shooting and killing of an African-American teenager, Trayvon Martin, by a neighborhood watchman, George Zimmerman, who was acquitted. Public opinion is that Florida's gun laws are overly lax, allowing people to carry firearms into the workplace (FS 790.251), transport them on public transportation, store them inside motor vehicles, and do not have mandatory firearms registration.
